You may not otherwise copy, display, transmit or distribute any material from the entire Website.

3.3 The material contained on the Website may contain inaccuracies or typographical errors. Law and More Limited make no representations about the accuracy, reliability, completeness or timeliness of the Website or the material. The use of the Website and the material is at your own risk.

3.4 All copyright, database rights and other intellectual property rights in the Website and the material available on the Website belongs to Law and More Limited or its third party suppliers. Use of the Website does not give you any proprietary rights in such materials.

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

7.3 Law and More Limited makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

7.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Law and More Limited for death or personal injury as a result of the negligence of Law and More Limited or that of its employees or agents.

8 INDEMNITY

You agree to indemnify and hold Law and More Limited and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Law and More Limited arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

9 SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

10 GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

11 JOBSEEKERS

11.1 JOBSEEKER PROFILES AND CV’S

Jobseeker CV’s contained on the Website are provided by jobseekers and are not reviewed by Law and More Limited. We accept no responsibility or liability for the contents of CVs. Jobseekers are solely responsible for the content of the CV’s posted on the Website. Prospective employers and their agents are expected to carry out such verification procedures as are customary and prudent in the circumstances.

11.2 JOB ADVERTISEMENTS

Services and information provided on the Website by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the Website in circumstances which may result in loss or damage.

12 EMPLOYERS/RECRUITERS

DEFINITIONS

In these terms and conditions:

12.1 'Client' means any person, company, organisation or firm which purchases Services on the website;

12.2 'Order Form' means an order for Services on a form provided by Law and More Limited (in any format) and signed by a Client;

12.3 'Services' means all recruitment products and services made available by Law and More Limited from time to time;

12.4 'Contract Month' means, in respect of any Order Form relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Order Form and ending on the day before the same date in the next calendar month. For example, the calendar month commencing on 24 February and ending 23 March;

12.5 'Contract Term' means the full term specified in the Order Form.

13 WEBSITE SERVICES & PRICES

13.1 We will not commence the provision of Services:

13.1.1 Payment has been made through the Website; and/or

13.1.2 An Order Form has been returned to us, in a form approved by us and signed by the Customer.

13.2 Prices are guaranteed for the period stated on the Order Form. Prices are confidential and may not be disclosed by the Client. All prices include VAT. All invoices shall be payable prior to any advertised vacancies being activated and commencing either on a monthly or annual contract arrangement.

13.3 A job posted on lawandmore.co.uk will remain live for the period agreed with the Client. Any extension of this time will be charged to the Client as a new posting. Any jobs posted in addition to the agreed number of jobs for the period will be charged at a price per job agreed with the Client at the time of the contract negotiation. If no price has been negotiated, rate per job as advertised on the Website will be charged for each job over the agreed number. A single job is identified by its unique ID number. If a Client deletes a job and then either reposts it or posts another, this will be classed as two jobs.

13.3 If any Services to be used within any time period specified on the Order Form are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Customer will be responsible for payment for any unused Services.

14 TERMINATION

14.1 The Client may terminate the provision of Services under any Order Form by no less than 30 days notice to expire at the end of a Contract Month. Termination by the Client before the end of the Contract Term may, at our discretion, result in loss of discounts agreed for the entire Contract Term.

We may terminate the provision of Services if:

the Client is in material breach of these Terms and Conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:

the Client becomes insolvent, ceases to trade or goes into liquidation.

15 JOB ADVERTISING

Job adverts go live:

after payment confirmation on www.lawandmore.co.uk; or

at the discretion of staff

15.2 If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that advertisements you place on the Website comply with your obligations under the Act and Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the advertisements you place on the Website.

We have rules regarding the content and format of jobs posted the Website. Their purpose is to ensure that users who search the Website get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from the Website any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly. In particular:

No duplicating of jobs at the expense of other Clients' jobs.

No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.

Job advertisements placed on the Website must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.

URLs or email links (live or text only) are not permitted in the body copy of the job description page. Email links are permitted from the 'send an email' link and URL linking is permitted from the 'apply online' link.

Advertisements which appear to discriminate on grounds of sex, race, disability or any other reasons that can not be shown to be justifiable are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from the Website without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.

It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post jobs on the Website.

16. JOB ADVERTISING RESPONSES

You agree to deal fairly and professionally with individual/jobseekers who may respond to a job advertisement you have posted and not do anything which may bring law and More Limited and/or the Website into disrepute. You will indemnify us from and against any claim brought by an individual against Law and More Limited arising from your breach of this obligation or any other of these terms and conditions. We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure

17. JOBSEEKER/CANDIDATE CV DATABASE

17.1 If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that the use you make of information from our candidate CV database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.

17.2 Database rights and all other applicable copyright and intellectual property rights in the candidate CV database belong to Law and More Limited. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.

17.3 The material you are entitled to receive from the candidate CV database is determined by the product you have purchased from us. On receipt of this material you may:

Use, search or download it to your database using the Candidate Search back office interface and its associated functions for the purpose of finding suitable candidates for specific job vacancies that you or (if you are an employment agency or employment business) your client wish to fill.

Use the information about the individuals contained in the database for the purpose of contacting them (through the Website) in relation to a specific job vacancy.

Use the information only in connection with your own recruitment-related activities.

You may NOT:

Supply, sell or license material from the candidate CV database, or a copy of it, to any other person, including another member of your group of companies.

Download the database through any automated (e.g. "scraping") process.

Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.

17.4 You agree to delete all material from the candidate CV database upon its replacement with up-to-date material or the satisfactory conclusion of your search for a suitable candidate, whichever occurs first.

17.5 You agree to deal fairly and professionally with individuals you may contact using information from the candidate database and not do anything which may bring Law and More Limited into disrepute. You will indemnify Law and More Limited from and against any claim brought by an individual against Law and More Limited arising from your breach of this obligation or any other of these Terms and Conditions.

17.6 Passwords are for the sole use of the person to whom they are issued. We may deny access to a password if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these terms and conditions.

18 ONLINE ADVERTISING

18.1 These Terms and Conditions apply to all advertising material ('Campaigns') accepted by Law and More Limited for display on the Website. By placing a Campaign you accept these Terms and Conditions as principal, even if you are acting as agent or buyer for the actual advertiser.

We must receive the complete creative content for a Campaign in acceptable format at least two working days before 9 am on the go- live date specified in your order. Otherwise, we may not be able to achieve the specified go-live date but you must pay the full amount set out in the order irrespective of whether any delivery target for impressions have been met.

To cancel or alter your order you must inform us, by fax or email at the number or address on the order, at least two working days before 9 am on the go- live date specified in your order. You are responsible for the content of the Campaign and for ensuring that it complies with all relevant legislation and codes of practice. If we receive complaints about the content or the Campaign we may, at our discretion, remove the Campaign from display without reference or liability to you. You will indemnify us against any claim that the Campaign or its content infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive. If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is your responsibility to ensure the advertisements you place on the Website comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2004.

You are also responsible for fulfilling and dealing with any orders or enquiries relating to the goods or services to which the Campaign relates and you will indemnify and hold us harmless accordingly.

Your sole remedy if we, or our third party subcontractors who may host and serve Campaigns from time to time, make an error in displaying any Campaign is the cost of re-running the relevant Campaign. Neither we nor our subcontractors shall be liable in any circumstances for any loss of profit or business. We shall, additionally, have no liability for failure to display the Campaign caused by circumstances outside our control.

19. PRIVACY POLICY

Law and More Limited is committed to protecting your privacy and maintaining the security of any personal information received from you. We strictly adhere to the requirements of the data protection legislation in the UK. The purpose of this statement is to explain to you what personal information we collect and how we may use it.

We make every effort to comply with our obligations under the 1998 Data Protection Act. Additionally, we understand the importance of maintaining the confidentiality of your CV and other information stored about you while using the site.

You can remove any of the information that Law and More Limited stores about you, at any time, by logging in to your account and choosing to close the account.

19.1 REGISTRATION

Contact and other details you supply as part of the registration process are stored by us and used to provide you with the information you have requested.

19.2 ACCOUNT, PROFILE AND CV INFORMATION

When you complete your Law and More account profile, including your CV, it can be made available for searching, viewing over the Internet and downloading by any direct recruiter, employment consultant or other person or organisation who requests CVs matching your profile to be sent to them. Law and More Limited does not verify the identity or the nature of the business of such organisations.

IMPORTANT: Your current employer may be a Client of Law and More Limited. Although we can restrict the Clients who access profiles on our candidate CV database we cannot be held responsible for any eventuality to the contrary. As part of the registration process Law and More Limited offers you the option of remaining anonymous.

Some of our customers may be located in countries outside the European Economic Area.

When you 'apply online', we store some information about you in your account area, but it is protected by your password and may only be accessed by you. It does not form part of our candidate CV database and cannot be searched or accessed by Clients.

You can delete your account at any time. Your CV can only be viewed by a Client if you have consented to this within the profile section. If you choose to create a profile and upload a CV to our database, we rely on you to ensure that your details are kept up to date. You should update your CV at least every six months, particularly if your contact details have changed.

Please note that Law and More Limited reserve the right to remove from our database, CVs which include any content that we consider to be illegal or offensive.

19.3 COOKIES

We use a technology called "cookies" as part of a normal business procedure to track patterns of behaviour of visitors to our site. A cookie is an element of data that our Website sends to your browser which is then stored on your system. You can set your browser to prevent this happening. Any information collected in this way can be used to identify you unless you change your browser settings.

19.4 STATISTICAL INFORMATION

We provide aggregate statistical information about site visitors and users to recruiters (such as the number of CVs on the database, or the number of visitors to the site) and for other lawful purposes. We provide this information to customers, advertisers, suppliers and other reputable third parties. This will not include any information that enables them to identify individuals.

19.5 SECURITY

The site is protected against unauthorised access using the latest security devices and 'firewalls'.

In order to process credit/debit card transactions, the bank or card processing agency may require verifying your personal details for authorisation outside the EEA (European Economic Area). Your information will not be transferred outside the EEA for any other purpose. There is no charge for candidates seeking jobs on our website.
