'Non Lawyers' to fight cases

Plans for non-lawyers to conduct criminal trials have been criticised by the Bar Council today (18.02.08)

The proposed plans put forward by the Crown Prosection Service would bestow paralegals with extended powers to present cases in court, primarily to alleviate the work load of fully qualified prosecutors. The change means that paralegals, who are allowed to lead hearings where the defendant pleads guilty, will also be able to prosecute in 'not guilty' cases.

Although the plans would give paralegals extended powers, only half of the 400 paralegals invovled felt that they were sufficiently well trained to prosecute. Over 30% of respondents also expressed concern over added pressures and carrying out work which is beyond their capabilities.

Tim Dutton QC, Bar Council Chairman, said that he was still hopeful that ministers would alter the planned reforms.
